Terms of Use

These Terms of Use ("Terms") govern your use of the CalZen mobile application, website at calzen.ai, and related services (together, the "Services"), provided by 42apps LLC ("CalZen", "we", "us", or "our"). These Terms apply to nutrition and medication tracking, AI features, Premium subscriptions, and one-time purchases.

1. Acceptance and Eligibility

By using the Services, you agree to these Terms. If you do not agree, do not use the Services. You must meet the age requirements in our Privacy Policy and be legally able to enter into this agreement, or have the permission of your parent or legal guardian where permitted by applicable law.

2. Your Information and Access

To use or restore certain features, you may need to provide an email address or purchase information. You are responsible for the accuracy of the information you enter, keeping your device and account credentials secure, and reviewing your saved settings and records. Features and purchase options may differ by platform, app version, region, and offer.

3. Privacy

Our Privacy Policy explains the data processed for tracking, AI generation, purchases, analytics, and support. Accepting these Terms does not replace any separate permission or explicit consent required for health data, health integrations, tracking, or sharing personal data with an AI provider.

4. Content and Intellectual Property

The App, software, design, and other CalZen materials are owned by 42apps LLC or its licensors, except for content you provide. You retain your rights in your own entries and uploaded content. You permit us and our service providers to process that content as needed to provide the features you request, as described in the Privacy Policy. You must have the right to submit any content you provide.

You may use the Services and the meal plans supplied to you for your personal, non-commercial purposes. A personalized plan is not necessarily unique: recipes, images, or similar results may also be used in other plans. Purchasing a plan does not give you exclusive rights to those materials.

5. Purchases, Subscriptions, and Payment

5.1 Premium subscriptions

Some features are available through a recurring Premium subscription. The price, currency, billing period, included features, and any trial or introductory conditions are shown before you confirm the purchase. Where offered, a trial or introductory period converts to the stated paid subscription unless canceled in time. A free trial is included only if the offer expressly says so.

Subscriptions automatically renew until canceled. For Apple purchases, payment is charged to your Apple Account at confirmation of purchase, and renewal may be charged within the 24 hours before the current period ends. Turn off automatic renewal at least 24 hours before the period or trial ends to avoid the next charge. You can manage or cancel an Apple subscription in Settings → your name → Subscriptions. For Google Play purchases, use Play Store → Payments & subscriptions → Subscriptions and follow the cancellation deadline shown by Google. For website purchases, use the management link in your payment confirmation or contact hello@calzen.ai.

Canceling your subscription stops future renewals. You generally keep access through the end of the period you have paid for. Deleting the App, hiding a feature, or deleting tracking data does not cancel a subscription. Any unused trial portion may be forfeited if you purchase a subscription, where the store's terms provide for this.

5.2 One-time weekly meal-plan purchases on iOS

A weekly meal plan is a separate, one-time in-app purchase for one personalized menu covering seven calendar days, with recipes and a shopping list. It is not a subscription and does not renew automatically. A new menu requires a separate purchase that you expressly confirm, unless you have an unused purchase available. The price and currency are those displayed by the App Store before confirmation.

The menu purchase does not itself grant or renew Premium. If Premium is required to buy your first plan, that requirement is shown before checkout. You can continue to access a purchased plan after your Premium subscription ends, subject to Section 10. The seven-day period refers to the dates covered by the plan; you are not charged for another week unless you choose to buy a new plan.

Generation begins after payment is verified and may take time or be temporarily unavailable. A payment confirmation alone does not mean that a usable menu has been delivered. A purchase is associated with one menu request. Retrying a failed request or reopening the same purchased menu does not require another payment. A retry completes the original request. It does not include unlimited new plans or a new plan based on different questionnaire answers.

You can open previously purchased plans in your menu history or use the restore feature to recover them. To recover a purchase after reinstalling the App, use the same Apple Account and the available restore function; an internet connection and verification of the transaction may be required. Restoring a plan retrieves the existing result without another purchase. See Section 10 for service availability and our Refund Policy if an eligible purchase cannot be recovered or fulfilled.

5.3 Payment channels and refunds

Apple and Google handle purchases billed through their respective stores. Website payments are handled by the provider identified at checkout; where Paddle is identified as merchant of record, Paddle sells and bills the purchase under its buyer terms. The relevant store or checkout terms apply to payment, taxes, refunds, and subscription management. Price changes apply in accordance with those terms and applicable law, including notice or consent where required.

Our Refund Policy explains cancellation, technical purchase problems, and how to request a refund for each payment channel. Nothing in these Terms limits mandatory consumer rights.

6. Changes to These Terms

We may update these Terms as the Services or legal requirements change. We will post the revised version with its update date and give notice of material changes through the App, website, or another appropriate channel. Where required, we will obtain consent or provide advance notice. Changes do not remove rights you already have for an existing purchase under applicable law.

7. Suspension and Termination

We may restrict or suspend access when reasonably necessary to address fraud, unauthorized use, a material breach of these Terms, security risks, or a legal requirement. Where practicable and lawful, we will explain the restriction and how to contact support. Restrictions, discontinuation, and any refund obligations remain subject to applicable law and the terms of the relevant purchase.

8. Health Information and GLP-1 Tracking Disclaimer

Not a medical service. CalZen is a personal tracking, calculation, and informational application. It is not a medical service and is not intended to function as a medical device. CalZen does not provide medical advice, diagnosis, prescriptions, or treatment, and does not replace a qualified healthcare professional. Its calorie tracking, meal analysis, nutrition goals, weight tracking, GLP-1 medication logs, reminders, charts, meal plans, and other tracking features are provided for convenience and informational purposes only.

Consult your healthcare professional. Consult your physician or another qualified healthcare professional before starting a diet, fitness program, or weight loss plan. Nutrition estimates and goals based on your entries do not constitute a medical assessment and may not account for your medical conditions, health history, or individual nutritional needs.

Medication and dosing decisions. Use the GLP-1 tracker only to record a treatment plan prescribed to you by a qualified healthcare professional. Decisions about whether a medication is suitable for you, which medication to use, the dose, administration method, dosing interval, and any treatment changes must be made with your prescribing healthcare professional. Consult that professional before starting or changing treatment. Do not start, stop, switch, increase, decrease, skip, repeat, or reschedule a dose based on CalZen's calculations, charts, notifications, or other content. If you are unsure about a dose or a missed dose, contact your prescriber or pharmacist.

Your responsibilities and risks. You are responsible for entering and checking accurate information, recording your prescribed regimen correctly, following your clinician's instructions and the medication's official instructions, and seeking medical advice when needed. You remain responsible for your own decisions and actions concerning medication use and assume the risks associated with decisions you make independently of professional medical guidance. Listing a medication or allowing you to record a dose does not mean that CalZen recommends or confirms its suitability or safety for you.

Calculations and results. Medication-level charts, timing estimates, supply projections, and other calculated results are approximations based on your entries and the assumptions used by the App. They do not measure the actual concentration of medication in your body, determine a safe or effective dose, establish whether a medication is working, or confirm that a product is safe to use. Individual circumstances and inaccurate or incomplete records can affect the results. CalZen does not guarantee weight loss, medication effectiveness, freedom from side effects, or any other health outcome.

Reminders, symptoms, and emergencies. Reminders and notifications may be delayed or fail to arrive; they do not verify that a dose is due or safe to take. Symptom entries and safety messages are not a diagnosis, medical monitoring, or a complete assessment of risk. The absence of a warning does not mean that your symptoms or treatment are safe. Your entries are not monitored by a healthcare professional through CalZen. For a medical emergency, contact your local emergency services immediately.

Limitation of liability. To the extent permitted by applicable law, 42apps LLC is not liable for harm resulting from inaccurate user entries, failure to follow professional medical advice, or dietary or treatment decisions made in reliance on the App instead of professional medical guidance. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, or affects your mandatory consumer rights.

9. AI Features and Weekly Meal Plans

How the plan is prepared. CalZen uses the nutrition goals and preferences you provide, together with AI generation and available recipe resources, to prepare a weekly menu. Please review your dietary style, restrictions, allergens, excluded foods, available equipment, and other answers before purchase. The plan is based on those inputs, not a clinical evaluation. If you enable activity-based adjustments, CalZen may use your activity history to estimate a nutrition target on your device. That estimate may differ from your actual energy needs.

AI limitations. AI-generated food analysis, menus, recipes, translations, and images may contain errors, omissions, or unsuitable suggestions and are not individually approved by a healthcare professional before you receive them. Calories, macronutrients, fiber, portions, and preparation times are estimates. Actual values depend on ingredients, brands, quantities, and preparation. Targets may not be matched exactly. Generated images are illustrations and may differ from the recipe or the food you prepare. No particular weight, health result, or exact nutritional outcome is guaranteed.

Allergies and exclusions. The menu feature uses your selected restrictions, but it cannot verify the composition, labeling, manufacturing environment, or cross-contamination risk of the ingredients you buy or use. Do not treat a generated menu as a guarantee that food is allergen-free or safe for you. Check every recipe, package label, substitution, and preparation method. If you have a food allergy or need a special diet for a medical condition, ask a qualified healthcare professional whether the plan is appropriate for you.

Dietary and religious preferences. Options such as halal, kosher, vegetarian, or lactose-free are used as planning preferences; they do not certify ingredients, suppliers, kitchen practices, or religious compliance. You are responsible for choosing products and preparation methods that meet your requirements.

Health and medication. A meal plan is not a prescribed therapeutic diet and does not determine what nutrition is appropriate for your diagnosis or medication. If you are using GLP-1 medication or have a condition that affects eating or nutrition, discuss your plan with your healthcare professional. The medication and emergency limitations in Section 8 apply.

10. Availability and Your Records

Online generation, translation, verification, and recovery require a working internet connection and depend on third-party services. We do not guarantee uninterrupted operation, instant generation, or compatibility with every device. Temporary service failures do not remove your right to seek completion or another remedy for a paid purchase under the Refund Policy and applicable law.

We retain purchased menus to support the archive and recovery functions described in the Privacy Policy. Purchased plans do not automatically disappear from your archive after seven days. Continued online access and recovery depend on the availability of the Services. If we discontinue a paid feature, we will provide reasonable notice where practicable and address outstanding purchases and any required remedies under applicable law. Keep an independent copy of information important to you; CalZen is not a medical record or an emergency service.

11. Disclaimer of Warranties

To the fullest extent permitted by law, the Services and their content are provided "as is" and "as available". Except for any express commitments in these Terms or rights that cannot be excluded by law, CalZen disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement. We do not warrant that AI results or other content will be accurate, complete, suitable for your circumstances, or free of errors, or that the Services will operate without interruption.

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, the exclusions above apply only to the extent allowed by law. This section does not eliminate any obligation to provide paid content or any remedy you are entitled to under applicable law.

12. Limitations of Liability

To the fullest extent permitted by law, 42apps LLC and its officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, loss of data, or business interruption, arising from your use of or inability to use the Services. This exclusion applies regardless of the legal basis for the claim, including contract or negligence, even if we were advised that such losses were possible.

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, or gross negligence; death or personal injury caused by negligence where liability cannot lawfully be limited; or any other liability or consumer right that applicable law does not allow us to exclude or limit. If a limitation in this section is not allowed where you live, it applies only to the extent permitted by the law that governs your claim. These exceptions also apply to the health-related limitation in Section 8.

13. General Terms

If a provision of these Terms is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A delay or failure to enforce a provision does not waive our right to enforce it later. These Terms, the Refund Policy, and any specific purchase terms shown before checkout describe our agreement for the Services; the Privacy Policy explains how we handle personal information. For purchases made through an app store, the store's applicable terms and license conditions also apply.
